Please read this Disclaimer carefully. It supplements the Terms of Service and applies to all use of the SimplyWarmup platform. These limitations reflect the fundamental nature of email deliverability, AI-generated content, and third-party provider dependencies.

Nothing on the SimplyWarmup platform, in our documentation, in support communications, or in any content generated by the Service constitutes legal, compliance, financial, or professional advice of any kind. This Disclaimer, the Terms of Service, and the Privacy Policy are provided for informational purposes and do not constitute, and are not a substitute for, advice from qualified legal counsel.

If you have questions about anti-spam compliance, data protection law, employment law as it relates to inbox authorization, or any other regulatory obligation, you should seek independent legal advice from a qualified attorney in your jurisdiction. SimplyWarmup does not warrant that using the Service ensures compliance with any law, regulation, or Provider policy.

2. No Guarantee of Deliverability Outcomes

SimplyWarmup provides infrastructure and tooling designed to support inbox warmup and deliverability improvement. We do not guarantee, represent, or warrant any specific deliverability outcome, including but not limited to:

  • improved inbox placement rates or spam-folder avoidance;
  • higher email open rates or reply rates;
  • reduced bounce rates or domain blacklisting events;
  • acceptance or approval of your domain or IP by any mailbox provider, spam-filtering service, or email security vendor;
  • sustained health-score improvements over any time period;
  • prevention of provider-imposed sending limits, account suspensions, or domain deactivations; or
  • commercial outcomes including revenue, pipeline generation, or sales performance.

Email deliverability is influenced by a large number of factors outside SimplyWarmup's control, including your domain's historical reputation, DNS configuration (SPF, DKIM, DMARC), list quality, sending volume, recipient engagement patterns, mailbox provider algorithm changes, and the broader sending behavior of your domain. SimplyWarmup's warmup operations are one contributing input into deliverability, not a complete solution or compliance guarantee.

3. Health Scores Are Informational Estimates

The inbox health scores displayed in the Service are calculated from observed warmup-operation outcomes and available mailbox metadata. They represent SimplyWarmup's operational estimate of relative inbox health within the Clean Pool network at a point in time. They do not:

  • constitute a definitive or authoritative assessment of your inbox's deliverability reputation with any third-party provider;
  • reflect how Google, Microsoft, Yahoo, or any other mailbox provider has classified or rated your domain or IP;
  • guarantee that emails sent from that inbox will reach recipient inboxes; or
  • serve as evidence of compliance with any anti-spam or data protection law.

Score methodology, weighting, and thresholds may change without notice as we improve the Service. Health scores are recalculated on a rolling basis and may fluctuate day-to-day based on warmup activity, Clean Pool interaction rates, and spam-folder rescue outcomes. A declining score on any given day does not necessarily indicate a permanent or worsening trend; short-term variance is expected and normal. You should evaluate trends over multiple days or weeks rather than acting on single-day readings.

4. AI-Generated Content Disclaimer

The Service uses third-party large language models (currently Google Gemini) to generate warmup email subjects, body text, and conversational replies. You expressly acknowledge that:

  • AI Output may be inaccurate, misleading, contextually inappropriate, legally insufficient, or otherwise unsuitable for any specific purpose;
  • AI Output may occasionally contain language, phrasing, or content that is repetitive, generic, or of reduced quality;
  • SimplyWarmup does not review, edit, or guarantee the accuracy or appropriateness of individual AI Output items generated at scale;
  • AI Output used solely for automated warmup operations within the Service operates under service tolerances designed for that purpose and should not be repurposed for campaigns, proposals, or customer-facing communications without human review; and
  • you bear sole responsibility for any AI Output you use, modify, or distribute outside of automated warmup operations.

SimplyWarmup is not liable for any claim, loss, or damage arising from AI Output, including claims of defamation, copyright infringement, inaccuracy, or regulatory violation arising from generated content.

5. Provider Dependency Disclaimer

The Service depends on the continued availability and unchanged policies of Google Workspace APIs, Microsoft Graph APIs, and other third-party services. SimplyWarmup has no control over Provider decisions, including decisions to:

  • restrict, revoke, or discontinue API scopes, features, or access;
  • change OAuth verification requirements, permission models, or data-use policies;
  • suspend or terminate your Google Workspace or Microsoft 365 account independently of SimplyWarmup's actions;
  • classify warmup activities as spam or policy violations under future platform rules; or
  • modify the infrastructure, rate limits, or security requirements that affect Service performance.

SimplyWarmup will endeavor to adapt the Service to Provider policy changes but makes no guarantee of uninterrupted service continuity if a Provider makes changes incompatible with current Service functionality. We are not liable for losses arising from Provider API changes, account suspensions by Providers, or mailbox limitations imposed by Providers.

6. Customer Anti-Spam Compliance Responsibility

SimplyWarmup operates a warmup network to improve the reputation of business inboxes. The Service does not manage, review, or approve outbound sales campaigns, marketing emails, or other commercial communications you send from your inboxes. You remain solely and fully responsible for:

  • the content, targeting, consent, and lawfulness of every email you send from Connected Inboxes, whether or not those inboxes are enrolled in warmup;
  • compliance with CAN-SPAM, CASL, GDPR, and any other applicable anti-spam or data protection law in your and your recipients' jurisdictions;
  • maintaining required unsubscribe mechanisms, consent records, and sender identification in your outbound campaigns;
  • ensuring that your sending list was lawfully obtained and that recipients have the appropriate relationship or consent basis; and
  • responding to and honoring any unsubscribe or opt-out requests promptly.

Improved deliverability does not make non-compliant sending lawful. SimplyWarmup may suspend accounts that generate disproportionate spam complaints or abuse signals, irrespective of whether a formal legal violation has been established.

7. No Warranty of Uninterrupted Service

The Service is provided on an “as is” and “as available” basis. SimplyWarmup does not warrant that the Service will be available continuously, error-free, or free from security vulnerabilities. Scheduled maintenance, infrastructure incidents, Provider API outages, and background-job failures may cause temporary interruptions in warmup operations, analytics availability, or inbox access.

When a Provider API becomes unavailable, background warmup jobs are designed to pause automatically and resume when connectivity is restored. We are not liable for warmup cycles that were missed, delayed, or partially completed during a Provider outage, nor for any deliverability impact that may result from such interruptions. We will endeavor to minimize downtime but make no guarantee of any specific uptime percentage or recovery time objective.

8. Limitation of Liability

To the maximum extent permitted by applicable law, SimplyWarmup's liability for any claim arising from reliance on outcomes described in this Disclaimer is limited as set forth in the Terms of Service, Section 12. Nothing in this Disclaimer creates any new or expanded liability beyond what is stated in the Terms.
