Acceptable Use Policy

This Acceptable Use Policy (“AUP”) is incorporated into the Terms of Service and applies to all customers and users of the SimplyWarmup platform. Violations of this AUP may result in immediate suspension or termination without notice or refund.

1. Purpose

SimplyWarmup operates a Clean Pool network for business-grade email warmup and deliverability improvement. The integrity of this network depends on every customer using it responsibly and in good faith. This AUP defines what is permitted and what is prohibited to protect all customers, the platform, Provider relationships, and the broader email ecosystem.

2. Permitted Use

You may use the Service only to:

  • connect legitimate business inboxes hosted on Google Workspace or Microsoft 365 to the warmup network;
  • send and receive AI-generated warmup messages within the SimplyWarmup Clean Pool to improve inbox reputation;
  • monitor inbox health scores and deliverability analytics associated with your Connected Inboxes;
  • use spam-rescue features to move SimplyWarmup warmup messages from the spam folder back to the inbox;
  • access the API and developer tools for legitimate, authorized integration with your own applications and workflows, in compliance with documented rate limits and fair-use guidelines; and
  • access the API documentation, developer sandbox (where available), and support resources for the purposes above.

3. Prohibited Use — Mailbox and Domain Standards

You must not:

  • connect consumer email domains (Gmail.com, Outlook.com, Yahoo, Hotmail, or similar) or any mailbox not operating under a business workspace license;
  • connect shared hosting, bulk mailing, or relay-only email accounts not backed by a genuine business identity;
  • connect mailboxes you do not own or for which you do not have explicit written authorization from the account holder or controlling organization;
  • connect mailboxes whose domains are under blacklisting, suspended for abuse, or actively involved in spam complaints; or
  • connect more inboxes than your active Subscription permits or attempt to circumvent per-inbox billing.

4. Prohibited Use — Content and Messaging

You must not use the Service to send or facilitate:

  • Phishing or fraud: messages designed to deceive recipients into providing credentials, financial information, or personal data;
  • Malware distribution: messages containing or linking to malicious code, exploits, or harmful payloads;
  • Impersonation: messages that falsely represent the sender's identity, organization, or domain in violation of applicable law or Provider policy;
  • Deceptive routing: use of forged headers, falsified sender information, or misleading routing data;
  • Spam campaigns: unsolicited commercial messages at scale, regardless of warmup status;
  • Unlawful surveillance: tracking technologies, beacon pixels, or methods designed to collect personal data from recipients without disclosure and lawful basis; or
  • Prohibited content: child sexual abuse material, non-consensual intimate imagery, terrorism, or content otherwise prohibited by applicable law.

5. Prohibited Use — Data Handling

You must not:

  • upload, submit, or process in the Service any special-category personal data, including health records, financial credentials, government-issued identifiers, biometric data, or payment card numbers;
  • use the Service to build lists, profiles, or enrichment databases from Pool Participant Data, Mailbox Data, or other customer data accessed through Service operations;
  • export, copy, or retain Pool Participant Data (including email addresses of other warmup network participants) for any purpose outside of authorized Service operations;
  • use data accessed through the Service to contact, solicit, or target individuals or organizations outside of the warmup network without their independent consent; or
  • attempt to scrape, harvest, or systematically extract data from the Service or its APIs beyond normal Service usage.

6. Prohibited Use — System and Network Integrity

You must not:

  • attempt to gain unauthorized access to SimplyWarmup systems, accounts, infrastructure, or other customers' data;
  • perform or facilitate denial-of-service attacks, load testing without authorization, or any other action that degrades Service performance;
  • probe, scan, or test the vulnerability of SimplyWarmup systems without prior written authorization from SimplyWarmup security;
  • introduce malware, viruses, or destructive code into the Service or connected Provider systems;
  • reverse-engineer, decompile, or disassemble the Service except to the extent expressly permitted by law;
  • circumvent, disable, or defeat any security or authentication control;
  • share account credentials with individuals outside your authorized organization; or
  • create or use automated scripts or bots against the Service beyond normal API usage within documented rate limits.

7. Prohibited Use — Provider Policy Compliance

Your use of the Service must not violate Google Workspace Terms of Service, Microsoft 365 Terms of Service, or any applicable Provider API use policy. In particular, you must not:

  • use the Service in a way designed to circumvent Provider rate limits, sending policies, or security controls;
  • use the Service in conjunction with accounts flagged by Providers for abuse, spam, or terms violations; or
  • configure the Service to access Provider data in ways not permitted by the scopes you authorized or in ways that conflict with Provider policy.

8. Anti-Spam and Sending Obligations

The warmup network exists to improve inbox reputation for legitimate business outreach. It does not excuse or enable spam. You agree that:

  • any outbound campaigns you run from Connected Inboxes must comply with all applicable anti-spam laws, including CAN-SPAM, CASL, and GDPR;
  • you will not use a warmup health score as a representation that your sending complies with anti-spam law;
  • you will promptly honor all opt-out and unsubscribe requests received in connection with any commercial email you send; and
  • you will not represent to recipients, regulators, or third parties that SimplyWarmup reviewed or approved the content of your outbound campaigns.

9. Reporting Abuse

If you encounter abuse on the platform, discover a potential security vulnerability, or believe another customer is violating this AUP, please report it to [email protected]. We take all reports seriously and will investigate promptly.

10. Enforcement

SimplyWarmup reserves the right to:

  • immediately suspend or terminate access for any violation of this AUP or where continued operation poses risk to the platform, Provider relationships, or other customers;
  • remove Connected Inboxes from the warmup network at our sole discretion when they generate elevated abuse signals, spam complaints, or blacklisting events;
  • preserve evidence of violations for legal and regulatory purposes; and
  • cooperate with law enforcement, Provider abuse teams, and anti-spam organizations in investigations of AUP violations.

Enforcement decisions are made at SimplyWarmup's sole discretion. We are not obligated to provide notice or a cure period before suspending accounts where we determine the risk is immediate or severe. We are not liable for losses arising from enforcement actions taken in good faith against accounts in violation of this AUP.

If you believe an enforcement action was taken against your account in error, you may submit a written appeal to [email protected]. Appeals are reviewed at our discretion. We are not obligated to reinstate access or reverse enforcement actions pending review, and an appeal does not suspend or modify any active enforcement measure.

11. Changes to This Policy

We may update this AUP from time to time. Material changes will be communicated by email or in-app notice with at least fifteen (15) days' advance notice before taking effect. Continued use of the Service constitutes acceptance of the revised AUP.
